Terms of Use

The rules, responsibilities and limits that apply when you use AuctionSetu.

1. Agreement and eligibility

By accessing AuctionSetu, purchasing Auction Access or using Bid Guidance, you agree to these Terms and the linked Privacy and Refund Policies. AuctionSetu is operated by NINECC EDUCATION INDIA PRIVATE LIMITED (CIN: U80903DL2019PTC359268).

You must be at least 18 years old and legally capable of entering into a contract. An organisation’s representative confirms that they have authority to act for it.

2. What AuctionSetu provides

Structured auction listings remain available without charge. Paid Auction Access may unlock official notices and protected authorised contact details. Listing facts and Auction Records remain free. A ₹99 Auction File follows one identified property and detected re-auctions for 12 months. Unlimited passes provide access to available Auction Files during the stated 30-day, 90-day or 365-day period.

Bid Guidance is a separate human-support service. It may include onboarding, bidder-account and auction-platform registration guidance, an auction-specific document checklist, obvious completeness checks, form and upload guidance, official follow-up prompts, deadline tracking, platform orientation and bidding-stage handholding.

AuctionSetu is independent. A bank, lender, liquidator, auctioneer or bidding platform is not our partner or endorser unless we state that relationship explicitly.

3. Auction information

Listings may be compiled from permitted public or licensed material. Auction information can be delayed, incomplete, corrected, withdrawn or inconsistent. The official sale notice, corrigendum and instructions issued by the authorised seller or auctioneer always control.

You must independently verify the property or asset, reserve price, EMD, deadlines, eligibility, possession, dues, inspection arrangements, contact details and bidding process before acting. An archived listing is historical information and not an invitation to bid.

4. Bid Guidance scope and exclusions

Bid Guidance begins with a ₹1,999 assessment of one selected auction. The assessment covers an auction-specific timing and process review followed by a focused call. It is a paid service and does not guarantee acceptance into the full package. When AuctionSetu confirms that the case fits and you continue, the assessment fee is credited in full and the remaining package balance is ₹23,000.

The complete ₹24,999 Bid Guidance package lasts for 90 days and covers up to three selected auction applications in total. An application counts when substantive auction-specific work begins. Replacing an abandoned, completed or unsuitable application is not automatic and requires written agreement.

Guidance ends at the conclusion of the supported bidding stage. Unless separately agreed in writing with an appropriately qualified professional, AuctionSetu does not provide:

  • Legal due diligence, title opinion or court-case verification.
  • Valuation, market-price estimate or investment advice.
  • Physical inspection, engineering assessment or possession assistance.
  • Loan approval, financing or tax advice.
  • A decision on eligibility or a guarantee of bidder registration, bidding access or auction success.
  • Post-auction payment, sale-certificate, possession or Sub-Registrar Office registration assistance.
  • Representation as the bank, liquidator, auctioneer, advocate, valuer or property broker.

5. Buyer responsibilities and account control

You are responsible for accurate information, timely documents, independent professional advice and compliance with official auction conditions. You must personally control your auction account, password, OTP, payment instruction, EMD transaction and final bid.

Do not share passwords or OTPs with AuctionSetu. All EMD, tender fees, balance consideration and final bids must be submitted directly through the official process. Screen-sharing or a call may guide you, but you remain the person taking each action.

6. Fees, plan periods and refunds

Current access prices are ₹99 for one property, ₹999 for 30 days of unlimited Auction Files, ₹2,499 for 90 days and ₹6,999 for 365 days. Bid Guidance costs ₹24,999 in total for 90 days and three auction applications: ₹1,999 for the initial paid assessment and, only after fit is confirmed and you choose to continue, a ₹23,000 balance. All displayed AuctionSetu prices are final and inclusive of applicable taxes; no additional AuctionSetu tax or checkout fee will be added.

These are one-time payments and do not renew automatically. An access period begins when access is activated. Refund eligibility is governed by the Refund Policy. Bank fees, EMD, tender fees and third-party professional costs are separate and are not collected as part of AuctionSetu fees.

7. Acceptable use and intellectual property

You may use AuctionSetu for personal or internal business evaluation of auctions. You may not disrupt the service, bypass security or access controls, impersonate another person, upload unlawful material or use the service for fraud.

The AuctionSetu brand, page design, original writing, database structure and software are protected. Without written permission, you may not systematically scrape, copy, republish, resell or create a competing database from the catalogue. This restriction does not claim ownership over an official auction notice or facts owned by their respective rights holders.

8. Third-party services

External websites, auction platforms, banks, professionals and payment providers are outside AuctionSetu’s control. Their terms, privacy policies, availability and decisions apply separately. A link does not by itself mean endorsement or partnership.

9. Disclaimers and limitation of liability

AuctionSetu will use reasonable care in providing the purchased service, but cannot guarantee uninterrupted access, error-free information, third-party performance, asset condition, clear title, eligibility or auction success.

To the maximum extent permitted by applicable law, AuctionSetu is not responsible for indirect or consequential loss arising from third-party decisions, official information, missed opportunities or use of the catalogue. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

10. Suspension and termination

We may restrict access for fraud, abuse, non-payment, security risk, unlawful conduct or material breach of these Terms. You may stop using the website at any time. Ending the service does not remove payment, confidentiality or other obligations that by their nature continue.

11. Governing law, changes and contact

These Terms are governed by Indian law. Courts having jurisdiction over the legal operator’s registered or principal office will have jurisdiction, subject to any mandatory consumer forum or other statutory right.
